Background Analysis

Police Squad car was traveling westbound on Dowling Avenue N. when officer dropped a can of sparkling water and attempted to pick it up and as officer was attempting to pick up the can he rear ended the vehicle claimant was a passenger in.  The crash caused rear end damage to the vehicle claimant was in and front end damage to the squad car.  Claimant's injuries include neck and low back pain and some shoulder pain.  Claimant brought an action to recover for his personal injuries.  Parties reached a tentative settlement in the amount of $18,000.00 payable to claimant's attorney's trust fund.  The Police Department and the City Attorney's Office believes that this settlement is in the best interest of the City and therefore recommends approval by this Committee and the City Council.
