Background Analysis
Tyler, et al. v. Hennepin County, et al. is a class action lawsuit. The plaintiffs alleged that that the State of Minnesota engaged in a practice wherein it would seize real estate property based on unpaid property taxes and sell the property for amounts that exceeded the property tax owed. The state would then retain the entire proceeds of the sale, depriving both the property owner of any equity in the property and preventing any other creditors from collecting amounts that they may have had secured by the property. The Court has approved a settlement of the case, and class members may now make claims as to amounts owed on properties that were seized by the state. To resolve any interest the City has in the case, the City Attorney's office will submit claims based on specific properties that it will identify as having been seized by the state and having outstanding balances on loans provided by the City. The City Attorney's Office believes that the proposed settlement is in the best interests of the City and recommends approval.
