Background Analysis

For the past year, the City has been piloting an E-discovery and redaction system. This pilot has provided the City Attorney and City Clerk’s offices an opportunity to evaluate the capabilities contained within E-discovery platforms. E-discovery and redaction software supports the review and redaction of large amounts of electronic data. The Attorney’s office utilizes the software in handling litigation matters, subpoenas, and investigations. The Clerk’s office utilizes the software in fulfilling public records requests under the Minnesota Government Data Practices Act.

The Information Technology (“IT”) department, along with the City Attorney and City Clerk’s offices, reviewed the departmental business requirements and noted additional needs discovered during the trial period. Since an E-discovery Platform could become an enterprise solution used by multiple City departments, IT issued a Request for Proposal (“RFP”) in March 2018 for an E-discovery and redaction system.  IT issued an RFP and received five responses.  An evaluation team comprised of staff from IT, the City Clerk’s and the City Attorney’s offices evaluated the proposals and now requests to execute a contract with Everlaw, and to customize the liability terms and conditions within the contract.to cap Everlaw’s liability at the total sum of City payments made to Everlaw during the 12 months preceding the event that first gave rise to the claim.
